O DIREITO À IMPLEMENTAÇÃO DOS REAJUSTES DOS SERVIDORES DO GDF SOBRE VENCIMENTO BÁSICO E GRATIFICAÇÃO

O Distrito Federal vem se negando a conceder os reajustes definidos em lei vigente, sob a alegação genérica de ausência de dotação orçamentária, subtraindo dos servidores direito garantido há mais de três anos.

A mera alegação de falta de prévia dotação orçamentária não é suficiente para afastar a condenação do ente distrital ao dever de implementar integralmente o plano de reajuste salarial do servidor, não havendo, ademais, que se falar em violação à Lei de Responsabilidade Fiscal, pois o art. 19, § 1º, IV da LRF autoriza o pagamento de despesas com pessoal decorrentes de decisão judicial. E, ainda, conforme jurisprudência do STJ e do STF a limitação de despesas com pessoal pelos entes públicos, por força da Lei de Responsabilidade Fiscal, não pode servir de fundamento para elidir o direito dos servidores públicos de perceber vantagens legitimamente asseguradas por lei.

Além disso, nas defesas apresentadas pelo ente distrital, este não conseguiu comprovar que adotou as medidas previstas no art. 23 da LRF para preservar a remuneração dos servidores, quais sejam: eliminar nos dois quadrimestres seguintes o percentual excedente aos limites pré-estabelecidos, reduzir em pelo menos 20% as despesas com cargos em comissão e funções de confiança e exonerar servidores não estáveis.

O TJDFT vem acolhendo as ações judiciais promovidas pelos servidores e percebemos que a partir do momento que a ação judicial chega ao seu final (transita em julgado), o vencedor na demanda, no caso o servidor, costuma ter dúvidas acerca do recebimento de seu crédito. Em razão disso, seguem alguns esclarecimentos.

Com relação à correção dos valores:

O crédito do servidor deve ser corrigido pelo índice oficial de remuneração básica da caderneta de poupança (TR), nos termos da Emenda Constitucional nº 62/2009, até 25.03.2015, data após a qual os créditos deverão ser corrigidos pelo Índice de Preços ao Consumidor Amplo Especial (IPCA-E). Os juros de mora incidirão a partir da citação, nos termos do art. 1º-F da Lei 9.494/97.

Com relação à forma do pagamento:

Pelos valores apurados os servidores receberão, em regra, seu crédito através de precatório.

Como é formado um precatório?

Depois que a Justiça der ganho de causa definitivo ao servidor condenando o ente federativo a indenizá-lo, o Juiz expede um documento, nos moldes de ofício, endereçado ao Presidente do Tribunal de Justiça do Distrito Federal e dos Territórios, a quem cabe, por força constitucional, adotar as providências necessárias para que o pagamento se concretize.

Após o recebimento do pedido, o Presidente do TJDFT autoriza o início do processo de precatório, que é formado a partir de informações prestadas pela Vara, e que passa a ter andamento na Coordenadoria de Conciliação de Precatórios, unidade vinculada à Presidência.

O pagamento do precatório tem de observar uma ordem?

Sim. Nenhum precatório pode ser pago em desacordo com a ordem cronológica de registro (autuação) dos processos. Isso significa que a quitação de cada precatório tem, obrigatoriamente, que seguir a ordem numérica das autuações. A determinação está expressa na Constituição Federal, em seu artigo 100.

Nessa ordem serão pagos primeiro os precatórios alimentares e depois os não alimentares de cada ano.

Só existe precatório para pagamento das condenações do governo?

Não. Existe também a REQUISIÇÃO DE PEQUENO VALOR – RPV. No caso do Distrito Federal, a Lei Distrital 3.624/2005 fixou em 10 salários mínimos o patamar máximo da requisição de pequeno valor, por autor. Acima dessa quantia, o pagamento será feito mediante precatório.

Ainda existem precatórios pendentes de pagamento?

Sim, há precatórios e requisições de pequeno valor pendentes de pagamento. As RPV do Distrito Federal e do DETRAN estão sendo pagas dentro do prazo médio de 2 anos.

Já os precatórios devidos pelo Distrito Federal serão pagos em uma lista única do DF. Isso engloba precatórios devidos no TJDFT e no TRT e do TRF. O início da lista tem precatórios de 1997.

Existe alguma preferência para o recebimento de precatórios?

Sim. A Emenda Constitucional nº. 62 dispôs que maiores de 60 anos (na data da emenda – 9/12/2009, ou na data da expedição do Precatório) ou portadores de doença grave poderão receber até atuais trinta salários mínimos antecipadamente.

Quais são estas doenças?

Art. 13. Serão considerados portadores de doenças graves os credores cometidos das seguintes moléstias, indicadas no inciso XIV do artigo 6º da Lei n.º 7.713, de 22 de dezembro de 1988, com a redação dada pela Lei n.º 11.052/2004.

Em relação ao pedido de uniformização do entendimento do Tribunal, conforme matéria veiculada no Correio Brasiliense no dia 10 deste mês, em que altera o cenário?

Caso o processo seja admitido, isso em nada altera a execução da sentença para quem tiver o trânsito em julgado de sua ação. Para os demais litigantes, será necessário aguardar a eventual uniformização para o prosseguimento do processo. Enquanto o Tribunal não responder o pedido, a tramitação dos processos prossegue. É importante ressaltar que tal procedimento está previsto no novo CPC e pode ser interessante para ambas as partes. De forma alguma tende a favorecer a tese do GDF, como já abordamos, em relação à LRF ou qualquer outro aspecto.

É uma manobra ardilosa para, com base na uniformização de entendimento, justificar a impossibilidade de pagamento de uma conta tão alta?

Não. Por ser aplicado apenas às ações em curso, isso não se estende a todos os servidores. Tal procedimento está sendo muito utilizado. Quando se identifica uma demanda em massa no judiciário é normal que uma das partes peça esse tipo de julgamento. Isso tem um lado positivo também, pois caso o entendimento for em prol do servidor, ações em andamento vão andar muito mais rápido.
